Credit Reporting Privacy Code 2004 Amendment No 2

1. Title
This amendment is the Credit Reporting Privacy Code 2004 Amendment No. 2.
2. Commencement
This amendment comes into force on 1 April 2006.
3. Amendment to clause 5
Clause 5 is amended in the following manner:
Insert: in the appropriate alphabetical order:
credit default information means the credit information listed in paragraph (e) of the definition of credit information
4. Amendment to rule 2(2)
Rule 2(2) is amended in the following manner:
Omit: the word “or” at the end of sub-paragraph (d)(ii)
Omit: paragraph (e)
Insert: (e) that:
(i) the collection is from a debt collector that is enforcing a debt owed by the individual concerned; and
(ii) the information is identification information, supplementary identification information, credit default information or serious credit infringement information; or
(f) that the collection of the information is in accordance with an authority granted under section 54 of the Act.
5. Revocation
The Credit Reporting Privacy Code 2004 Amendment No 1 (Temporary) is revoked.

This note is not part of the amendment, but is intended to indicate its general effect.
This amendment, which comes into effect on 1 April 2006:
(1) Amends the Credit Reporting Privacy Code 2004 by:
• inserting a definition of “credit default information”
• amending rule 2(2) by adding a further exception permitting the collection of certain credit information from debt collectors.
(2) Revokes the Credit Reporting Privacy Code 2004 Amendment No 1 (Temporary).
The amendment commences on the same day as the relevant parts of the code being amended..
The amendment is deemed to be a regulation for the purposes of the Regulations (Disallowance) Act 1989.
