Can I publish things about my employer on social media?
While you have the right to express your opinions as part of your right to freedom of expression generally, you need to take care that you do not disclose information about other individuals which you have only obtained as part of your employment (as this may breach the Privacy Act).
Also keep in mind that, even if you are only sharing your views with friends, or a closed group, once you’ve made comments on social media, it’s possible the information will be passed on outside of your control. If your comments are in breach of your employment agreement, your employer might want to take disciplinary action.
If you are concerned that there may be employment consequences for making comments about your past or present employer, you may want to get in touch with Employment New Zealand(external link).
You should also be aware that if your comments are bullying or threatening, this could constitute a harmful digital communication. As of July 2015, new laws were introduced which relate to harmful digital communications(external link).
