Can I request someone’s information if I have Power of Attorney?

If you have Power of Attorney, or an Enduring Power of Attorney (for someone who no longer has capacity to act for themselves), you are considered to be acting on their behalf. So if you ask for that person’s information, the agency needs to respond as if that person was asking for their information directly.

If your request has been refused we suggest that you contact the agency and ask to speak to their privacy officer and see if you can resolve the matter directly.

However, if you’re not able to resolve the issue for whatever reason, you can make a complaint to us.
